Agreement between User and ruggedweeds.org:
Welcome to ruggedweeds.org. The ruggedweeds.org website (the "Site") is comprised of various web pages operated by Rugged Weeds L.L.C. ("Rugged Weeds"). ruggedweeds.org is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of ruggedweeds.org constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference.
ruggedweeds.org is a Life Coaching and Therapeutic Horticulture Site.
The purpose of this website is to educate and facilitate life coaching sessions, as well as Therapeutic Horticulture.
Privacy
Your use of ruggedweeds.org is subject to Rugged Weeds’ Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting ruggedweeds.org or sending emails to Rugged Weeds constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Scope of Services
Our life coaching services focus on personal growth, goal achievement, and life balance. Our empathic listening services include actively listening to our clients with empathy. Our services do not include therapy, medical advice, financial planning, or legal counsel.
The Coach-Client Relationship
The coaching and empathic listener relationship is a partnership aimed at enhancing the client's personal and professional life. The client is responsible for their own decisions, actions, and results. The coach provides support, feedback, and guidance to facilitate the client's growth and goal achievement.
Client Responsibilities
Clients agree to commit fully to their personal growth and development and to maintain an open mind and willingness to explore new perspectives. Clients and coach must be honest about their boundaries, preferences, abilities, and clearly address the level of progress. Client must complete any assignments between sessions that have been agreed upon. Clients and coach must agree to adhere to the agreed upon schedule, payment plans, and payment policies.
Confidentiality
All information shared during coaching and empathic listening sessions is strictly confidential, except in cases where there is a risk of harm to self or others, or as required by law in the state of North Carolina. The coach adheres to the International Coach Federation (ICF) Code of Ethics regarding confidentiality.
Session Procedures
Sessions will be conducted via video conferencing or over the phone. Scheduling will be done on our website, and we will communicate via email and phone. Clients are responsible for ensuring they have the necessary technology and a private space for sessions.
Termination of Services
Either the client or the coach may terminate the coaching relationship at any time, via call or email. For upfront payments, only completed sessions will be billed, and any remaining balance will be refunded.
Payment Policy
Clients may choose to pay upfront or in installments (per session). All payments are non-refundable unless rescheduling or canceling a minimum of 24 hours before scheduled appointments (See the Cancellation/Refund Policy Below). Payment is due before each session or at the beginning of the package, depending on the chosen payment plan.
Cancellation/Refund Policy
Please contact us using the Contact form with any questions or concerns.
Cancellation: A minimum or 24 hours notice is needed for a full refund. Subsequent cancellations will be charged in full.
Missed Sessions: The first missed session is forgiven. Subsequent missed sessions will be charged in full.
Rescheduling: A minimum of 24 hours notice is required to receive a refund. The first late rescheduling is forgiven. Subsequent late rescheduling does not receive a refund, and will be charged in full.
Materials Provided to ruggedweeds.org or Posted on Rugged Weeds
Rugged Weeds does not claim ownership of the materials you provide to ruggedweeds.org (including feedback and suggestions) or post, upload, input or submit.
No compensation will be paid with respect to the use of your Submission, as provided herein. Rugged Weeds is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in Rugged Weeds’ sole discretion.
By posting, uploading, inputting, providing, or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
Intellectual Property
All materials, methods, and techniques used in the coaching process are the intellectual property of the coach and may not be reproduced or distributed without express permission.
International Users
The Service is controlled, operated, and administered by Rugged Weeds from our office within the USA, and on servers hosted within the USA.
Indemnification
You agree to indemnify, defend and hold harmless Rugged Weeds, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Rugged Weeds reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Rugged Weeds in asserting any available defenses.

Coaching and empathic listening is not a substitute for professional medical, mental health, legal, or financial advice. The coach is not liable for the client's actions, decisions, or results. Results may vary, and no specific outcome is guaranteed.
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. RUGGED WEEDS LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
RUGGED WEEDS LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. RUGGED WEEDS LLC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
Termination/Access Restriction
Rugged Weeds reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of North Carolina, and you hereby consent to the exclusive jurisdiction and venue of courts in North Carolina in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Rugged Weeds because of this agreement or use of the Site. Rugged Weeds’ performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Rugged Weeds’ right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Rugged Weeds with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Rugged Weeds with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Rugged Weeds with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
Rugged Weeds reserves the right, in its sole discretion, to change the Terms under which ruggedweeds.org is offered. The most current version of the Terms will supersede all previous versions. Rugged Weeds encourages you to periodically review the Terms to stay informed of our updates.
By engaging in coaching and empathic listening services, the client acknowledges that they have read, understood, and agreed to these terms and conditions.
